Court Orders Evidence from Christa Pike’s Failed Execution Preserved as She Remains Shackled to Hospital Bed
A judge ordered Tennessee officials to preserve evidence that could help determine what went wrong during Pike’s failed execution
UPDATE: A Tennessee court on Wednesday ordered state officials to preserve evidence from Christa Pike’s failed execution, including needles, IV lines, medical supplies, surveillance footage, communications and even trash from the execution room. Pike’s attorney also told the court that corrections officers have kept her handcuffed and shackled to her hospital bed against the advice of medical staff. An attorney for the state declined to answer when asked by the court whether Tennessee still intends to execute Pike.
Christa Pike’s attorneys are asking a judge to order Tennessee officials to preserve needles, lethal injection drug information and other evidence from her failed execution as she remains hospitalized, now awake and able to speak.
Pike, 50, survived Tennessee’s attempt to execute her by lethal injection on Sept. 30 after she was given two doses of pentobarbital. Her attorneys are expected in court Wednesday, Oct. 7, where they plan to seek an order requiring the Tennessee Department of Correction to preserve evidence and provide more information about what went wrong, the ᴀssociated Press reported.

The evidence Pike’s attorneys want preserved includes drug lot numbers, needles, execution logs and other information related to the attempted execution, according to the AP.
“Against all odds, Christa Pike is conscious, speaking and continues to receive critical medical care,” her attorneys said in a statement, per the AP.

Her prognosis remains unclear and she faces, at minimum, a lengthy recovery, her attorneys said. They said Pike’s arms were burned and blistered following the attempted lethal injection and that she remains handcuffed to her hospital bed.
Attorneys for the Tennessee Attorney General’s Office argued in a Tuesday court filing that a preservation order is unnecessary because the prison system is already “obliged to maintain this evidence in other cases and must ᴀssure it is preserved,” according to the AP.
The state’s attorneys also said officials have taken “the necessary steps to obtain medical care for Pike and ascertain what occurred.”
Pike’s attorneys have raised questions about whether the IV lines used during the execution were properly placed, potentially allowing the lethal injection drug to enter her tissue rather than her bloodstream.
“Apparently at no point did any member of the execution team realize that the IV lines were not correctly placed or that the veins had blown,” her attorneys wrote in a court filing, according to the AP.

The execution began at around 7:30 p.m. local time on Sept. 30. About five minutes after Pike was given an opportunity to make a final statement, she raised her head and said her arm hurt, according to the AP.
She later appeared to lose consciousness but could still be heard breathing until media witnesses were escorted from the witness room at 8:53 p.m. An ambulance arrived at the prison at 9:14 p.m. and transported her to a hospital.
As PEOPLE previously reported, Pike was initially unconscious, intubated and on a ventilator following the execution attempt. Her attorneys previously said both of her arms were swollen, burned and blistered when she arrived at the hospital.
Pike’s attorneys announced on Oct. 6 that she had regained consciousness and was speaking, though the extent of her recovery remains uncertain.

Dr. Joel Zivot, a professor of anesthesiology and surgery who consulted as an expert for Pike’s legal team, told the AP that it could take weeks or months to determine what her recovery will look like and whether she would be competent for the state to attempt to execute her again.
Pike was convicted and sentenced to death for the 1995 beating and stabbing death of her Job Corps classmate Colleen Slemmer, 19. Pike was 18 at the time of the killing.
The Death Penalty Information Center has said Pike is the only person to survive after receiving lethal injection drugs during an execution.
Following the failed execution, Tennessee Gov. Bill Lee called what happened “deeply disturbing,” ordered a comprehensive third-party review of the incident and suspended all executions in the state for the remainder of 2026.
The head of the Tennessee Department of Correction has since announced his resignation.
