The prosecution argued that Lindsay was not psycH๏τic and that she deliberately planned to kill her children.
Judge William Sullivan declared a mistrial after jurors failed to reach a unanimous verdict.
The parties are due back in court on Sept. 29.

Patrick Clancy Says Slain Daughter Cora Visits Him in His Dreams: ‘Where Have You Been?’
Clancy told ‘60 Minutes’ he still dreams about his deceased children
Patrick Clancy says he still has dreams about his slain children, including a “lucid” dream in which he spoke to his daughter.
Clancy appeared on 60 Minutes with his new wife, Dr. Rachel Danis, and was interviewed by CBS correspondent Ross Douthat.
During the interview, Clancy discussed his grief over the loss of his children — Cora, 5, Dawson, 3, and 8-month-old Callan — who were killed in January 2023.
At one point, Douthat asked Clancy if he ever dreams about the children.
“I remember early on having a dream, maybe six months or a year after. And I’m in the kitchen at the house, and Cora walks in,” Patrick recalled. “And I just look at her and I, it was, like, I basically just said, ‘Where have you been?’”
“And she comes up to me and gives me a big hug,” he continued. “Those dreams are so real. It’s like I’m lucid in those dreams.”
Clancy also discussed his new marriage to Dr. Rachel Danis as well as conspiracy theories surrounding the case.
“It’s deeply harmful to the legacy of my children,” he said of the conspiracy theories. “It is a huge distraction from what really matters here, which is perinatal mental health. And it’s done real harm to real people, myself included but also others.”
Clancy and Danis, who live in New York City, married in April and told Douthat that they are starting a family.
The interview was the first time Clancy has spoken out since the trial of his ex-wife, Lindsay Clancy, ended.
Lindsay is charged with murder in the deaths of her three children with Patrick, who were strangled to death in their Duxbury, Mᴀss., home.
Patrick, who had been running an errand at the time of the killings, discovered his children in the basement of the home after he found Lindsay in the backyard seriously wounded from a suicide attempt.
Lindsay does not dispute that she killed the children but has pleaded not guilty by reason of lack of criminal responsibility. Her defense has argued she was suffering from postpartum psychosis at the time.
